1. Agreement to Terms These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Mystic Yunnan International Travel (Hong Kong) Limited (“ChinaMystic,” “we,” “us,” or “our”), a travel agency registered in Hong Kong SAR. By booking or participating in any tour or service offered by ChinaMystic, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms govern all travel services provided by ChinaMystic, including but not limited to tours, accommodation bookings, transportation arrangements, and related activities, primarily focused on inbound travel to Yunnan,Xizang,Xinjiang,China.
2. Booking and Payment
2.1 Reservation: To make a booking, please contact us via our website, email, or other official channels. Bookings are subject to availability and confirmation by ChinaMystic.
2.2 Deposit: A non-refundable deposit is required to secure your booking. The standard deposit is [Specify % or Amount, e.g., 30% or 50% as per your doc ] of the total tour cost per person. For tours involving special permits (e.g., Tibet) or during peak seasons, a higher deposit may be required, which will be advised at the time of booking. Deposit confirms your acceptance of these Terms.
2.3 Final Payment: The remaining balance of the tour cost is due [Specify timeframe, e.g., 30 or 45 days] days prior to the scheduled departure date. Failure to pay the balance by the due date may result in the cancellation of your booking and forfeiture of your deposit.
2.4 Late Bookings: For bookings made within [Specify timeframe, e.g., 30 days] days of departure, full payment is required at the time of booking to confirm the reservation.
2.5 Payment Methods: We offer a range of secure payment options for your convenience.
a) Secure Online Payments (Credit/Debit Card): We accept most major credit and debit cards, including Visa, Mastercard, and American Express. All online transactions are securely processed through our industry-leading, PCI-compliant payment partners, such as Stripe, PayPal, and Airwallex. To ensure your security, your full card details are never stored on our servers. Your booking is typically confirmed instantly upon a successful transaction.
b) Bank Transfer (Wire Transfer): This option is also available, typically for larger booking amounts. Our bank account details for the transfer will be provided on your booking invoice. Please be aware that you are responsible for all bank fees associated with the transaction.
2.6 Fees: Any bank charges, credit card processing fees, or fees related to currency conversion associated with payments are the responsibility of the Client. Tour prices are typically quoted in [Specify Currency, e.g., USD or EUR] unless otherwise stated.
3. Cancellation and Refund Policy
Cancellations must be submitted to mysticYN in writing (e.g., via email). The date of cancellation will be determined by the date on which we receive your written notification. As we incur significant costs in arranging your travel far in advance, cancellation fees are applied as outlined below.
3.1 Cancellation by the Client
Due to the nature of travel arrangements in regions like Yunnan, Xizang, and Xinjiang, which involve advance bookings for permits, accommodations, and transport, the following cancellation charges apply to the total tour cost:
- 30 days or more prior to departure: Full refund of all monies paid, minus the non-refundable deposit.
- 18 to 29 days prior to departure: 15% of the total tour cost will be charged.
- 17 to 10 days prior to departure: 50% of the total tour cost will be charged.
- 9 to 4 days prior to departure: 80% of the total tour cost will be charged.
- 3 days or less prior to departure, or no-show: 100% of the total tour cost will be charged (no refund).
Important Note on Non-Refundable Items: Please be aware that certain items are non-refundable from the moment of purchase, regardless of the cancellation date. These include, but are not limited to, special permits (e.g., Tibet Entry Permit), flight tickets, train tickets, and specific non-refundable hotel bookings. These costs will be deducted from any potential refund in addition to the cancellation charges listed above.
3.2 Cancellation by mysticYN We reserve the right to cancel a tour prior to departure for reasons such as insufficient participant numbers or other unforeseen circumstances. In such cases, we will offer you the choice of: (a) A comparable alternative tour, if available (any price difference payable by you or refunded by us). (b) A full refund of all monies paid to mysticYN for the tour package.
We are not liable for any incidental expenses incurred by you as a result of your booking (e.g., visa fees, non-refundable connecting flights).
3.3 Force Majeure mysticYN shall not be liable or provide refunds for cancellations or alterations due to Force Majeure events. These include, but are not limited to, acts of God, war, terrorism, civil unrest, pandemics, epidemics, natural disasters (e.g., earthquakes, floods, landslides), adverse weather conditions, government actions or regulations (including travel advisories or restrictions), and major failures of third parties (e.g., airlines).
In such events, we will endeavor to assist you with alternative arrangements or provide necessary documentation for your travel insurance claims. While refunds are not guaranteed, rescheduling your tour or offering a credit voucher for future travel may be offered at our discretion, depending on the specific circumstances.
- Alterations to Bookings
- Changes by the Client: If you wish to alter your booking after confirmation (e.g., change dates, itinerary components), please notify us in writing as soon as possible. Such requests are subject to availability and approval by ChinaMystic. An administrative fee (e.g., HKD 500 or USD 75 per change per person [cf. cite: 47]) plus any costs or penalties imposed by suppliers (hotels, airlines, etc.) will apply. Changes requested close to departure (e.g., within 14 days [cf. cite: 48]) may not be possible or may be treated as a cancellation under Section 3.1.
4.2 Changes by ChinaMystic: While we aim to operate all tours as advertised, we reserve the right to modify itineraries, accommodations, transport, or other arrangements due to local conditions, operational requirements, safety concerns, or unforeseen circumstances. We will inform you of any significant changes as soon as reasonably possible. If a significant change is made before departure that fundamentally alters the nature of the tour, you will have the option to accept the change, book an alternative tour (with price adjustment), or cancel and receive a refund as per Section 3.2(b) [cf. cite: 50]. Minor changes do not entitle you to a refund.
5. Client Responsibilities
5.1 Travel Documents: You are responsible for ensuring you possess a valid passport with at least six months’ validity beyond your planned return date, and obtaining all necessary visas, permits, and health documentation required for entry into China and travel within the specific regions of your itinerary. ChinaMystic can provide advice and assistance with applications (e.g., for Tibet permits) but does not guarantee issuance and is not liable if you are denied entry or unable to travel due to inadequate documentation.
5.2 Health and Fitness: You must be in sufficiently good health to undertake the tour. You are responsible for assessing the suitability of the itinerary based on your personal health and fitness levels, particularly concerning high-altitude travel (>3,000 meters) and adventurous activities (e.g., trekking) common in Yunnan. You must inform ChinaMystic at the time of booking of any pre-existing medical conditions, disabilities, or dietary requirements that may affect your ability to participate fully. We reserve the right to decline a booking or require medical clearance if we deem a tour unsuitable for you. Failure to disclose relevant health information may result in termination of your tour without refund.
5.3 Travel Insurance: Comprehensive travel insurance is mandatory for all clients participating in ChinaMystic tours. Your insurance must cover, at a minimum: trip cancellation/interruption, medical expenses (including emergency evacuation and repatriation), personal accident, baggage loss/delay, and personal liability. Given the nature of travel in Yunnan, including high altitudes and potential adventure activities, you must ensure your policy specifically covers these elements, including medical treatment for altitude sickness (AMS) and emergency evacuation from remote areas. Standard policies often have exclusions for high-altitude activities. You must provide proof of adequate insurance coverage to ChinaMystic before departure. Failure to obtain appropriate insurance releases ChinaMystic from liability for costs arising from events that would otherwise be covered by insurance.
5.4 Conduct: You agree to comply with the laws and customs of China and follow the guidance of your tour leader/guide. If your conduct is deemed disruptive, offensive, or dangerous to yourself, other clients, staff, or property, ChinaMystic reserves the right to terminate your participation in the tour immediately without any refund or liability for further costs incurred by you.
5.5 Assumption of Risk: You acknowledge that travel, particularly to remote or high-altitude areas and involving adventure activities, carries inherent risks (including injury, illness, loss or damage to property, inconvenience, and discomfort). By booking with ChinaMystic, you accept these risks and agree not to hold ChinaMystic liable for events beyond our reasonable control.
6. Liability and Limitations
6.1 Our Role: ChinaMystic acts as an agent in arranging services provided by independent third parties such as airlines, hotels, transport operators, and local guides. We exercise care in selecting these suppliers but do not own or control them.
6.2 Limitation of Liability: ChinaMystic and its employees, agents, and partners are not liable for any injury, death, loss, damage, accident, delay, inconvenience, or irregularity arising out of or in connection with: (a) Any act or omission (including negligence) of any third-party supplier. (b) Force Majeure events (as defined in Section 3.3). (c) Your own conduct, negligence, or failure to comply with these Terms (including health and insurance requirements). (d) Events beyond our direct control.
6.3 Financial Cap: To the extent permitted by law, our liability for any claim arising out of these Terms or your trip shall be limited to the total amount paid by you to ChinaMystic for the specific tour package in question [cf. cite: 59, Note: Your original 150% cap is unusual; typically liability is capped at the tour cost or less. Review this carefully with legal counsel]. We are not liable for any indirect, consequential, incidental, or punitive damages.
7. Data Protection We collect and process your personal data in accordance with our Privacy Policy [Link to Privacy Policy] and applicable laws like the Hong Kong PDPO and GDPR. By booking with us, you consent to the collection, use, and disclosure of your personal data as described therein for the purposes of arranging and providing your travel services.
8. Governing Law and Dispute Resolution These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms or your trip shall first be attempted to be resolved amicably through negotiation. If negotiation fails, the parties agree to attempt mediation through a mutually agreed mediator or institution (such as the Hong Kong International Arbitration Centre – HKIAC) before resorting to litigation. Failing resolution through mediation, any legal action shall be brought exclusively in the courts of Hong Kong SAR.
9. Amendments to Terms ChinaMystic reserves the right to update or amend these Terms and Conditions at any time. The currently effective version will be posted on our website. For substantial changes affecting existing bookings, we will provide reasonable notice, typically via email or website notification, at least [e.g., 30 days] prior to the change taking effect. Your continued engagement with our services after such notification constitutes acceptance of the amended Terms.
10. Severability If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
